AI Terms of Use
Part of the platform contract (Anlage 4)
01Subject matter
These terms govern the use of artificial intelligence in meda Doku and meda Abrechnung. They form part of the platform contract.
02Intended purpose
meda produces structured documentation from the consultation and proposes billing codes under EBM, GOÄ and HzV on that basis. Each proposal identifies the passage of documentation supporting it. meda makes no diagnosis, gives no treatment recommendation, issues no risk warnings and does not evaluate patient data for medical purposes.
03Not a medical device
meda is not a medical device within Regulation (EU) 2017/745. The software is not intended for the diagnosis, prevention, monitoring, prediction, prognosis, treatment or alleviation of disease.
04The physician decides
All output consists of proposals and takes effect only once a physician has reviewed and released it. Without release, no documentation enters the practice management system and no code is billed. No automatic transfer bypassing that step is provided. Responsibility for the accuracy and completeness of documentation, and for the selection and submission of every code, rests solely with the treating physician — including where a proposal is accepted unchanged.
05Limits of the technology
AI systems can produce incomplete or incorrect results. We warrant no particular accuracy rate and no commercial outcome. Every proposal must be reviewed before release; the evidence shown exists for that review.
06Customer obligations
The customer ensures that release is performed only by medical staff, every person works with their own named account, accounts are not shared, proposals are not accepted without review, and billed services were in fact provided and documented.
07Prohibited use
The platform may not be used to bill services not provided or not documented, for purposes prohibited under Article 5 of Regulation (EU) 2024/1689, to produce diagnostic or therapeutic decisions, or to process data the customer is not entitled to transmit.
08Transparency
The application makes clear that AI-generated content is involved. The deployer's obligations towards physicians and patients rest with the customer; on request we provide the information needed.
09Traceability
Every released code retains its link to the supporting passage, the releasing person and the time of release — beyond release, in particular for the Plausibilitätsprüfung.
10Liability
The liability provisions of the AGB apply. Liability for clinical decisions, for the accuracy of documentation and for the selection of billed codes is excluded.
